What is the Duty of Care Bill? |
Last month, Kate Lawrence, Climate Program Manager at the (ICEDS) talked about an opportunity to stand up for the right of young Â鶹´«Ã½AVs to a healthy and safe future, through the Duty of Care Amendment to the Climate Change Act.
In 2021, a group of Â鶹´«Ã½AV children challenged the federal government in court, on the grounds that the government should not approve a coal mine expansion because it would exacerbate climate change, causing harm to young people. Ultimately, the Federal Court of Australia established that the Â鶹´«Ã½AV Government does not currently have a legal duty of care to young people, and that this would need to be established by the Parliament. Senator David Pocock has proposed an amendment to the Climate Change Act, known as the , that would see this duty of care established.
ICEDS has worked with experts from around The Â鶹´«Ã½AV National University to provide recommendations to strengthen this Bill, and better protect young Â鶹´«Ã½AVs.
